Appeal Updates: Court of Appeals will Review Judge’s Finding

[b]APPEAL UPDATES[/b] Media attorney Theodore Boutrous filed an emergency motion Friday requesting the state Supreme Court review a sweeping gag order issued by Santa Barbara County Superior Court Judge Rodney Melville. Lead defense lawyer Mark Geragos backs the request. The gag order prevents attorneys and others involved in the case from speaking about it. The 2nd District Court of Appeal granted Mr. Geragos’ request Thursday to review Judge Melville’s findings about an audiotape seized during a law enforcement raid that he ruled the prosecution should be able to access. Mr. Geragos asserts it contains interviews he instructed a private investigator to conduct and is, therefore, confidential.
