Fmr. Sheriff Allowed to Taint Jury Pool by Judge? – MJEOL Bullet #195 In late news yesterday (September 10 2004), the judge in the Michael Jackson “case” has essentially allowed the former sheriff of Santa Barbara, Jim Thomas, to continue to taint the potential jury pool by refusing to hold a hearing to decide whether he should fall under the gag order in the “case”.

Thomas, who is currently an “analyst” for NBC, recently appeared on a defamatory Dateline NBC report in which he claimed there was evidence against Jackson in 1993. He, however, provided zero evidence or documentation speaking to the allegation. He is also a source regarding an alleged $2M settlement in 1990. Again, he provided zero documentation or other evidence speaking to that allegation either.

Thomas was the sheriff in 1993 and is a “crony” of Tom Sneddon, according to sources. While he clearly should fall under the gag order, the judge has refused to hold a hearing on the matter.

Controversy Brewing Over False Statements from Dimond, Court TV – MJEOL Bullet #194 A controversy is brewing between Diane Dimond of Court TV and Karen Faye, Michael Jackson’s long time friend and makeup artist. On August 18 2004, Court TV’s Crier Live ran a video report from tabloid reporter Diane Dimond in which Dimond claimed the Attorney General of California’s investigators received information from “informants” that Faye falsified the huge bruise on Jackson’s arm. Not only were these defamatory statements false, but they were statements which paint Faye as a criminal.

This is what was said by Dimond during the Aug 17 report:

DIANE DIMOND [video report]: Court TV has learned, exclusively, much time was spent trying to find and question this woman: Karen Faye, Michael Jackson’s loyal, long-time make-up artist.

She’s seen here in a recent Fox special. According to confidential sources close to the investigation, informants told the AG’s office it was Faye who had actually applied makeup to create the bruise seen here on Jackson’s arm. And that it was all smoke and mirrors.

Without providing the names of any of these “informants” or the name of the “source(s)” who “exclusively” told Court TV that the AG was searching for Faye, Dimond rather recklessly left a serious allegation of illegal activity hang out there for the public.

Part2: Sneddon has History of Prosecutorial Misconduct? MJEOL Bullet #190-B In part two of MJEOL Bullet #190, “Sneddon has History of Prosecutorial Misconduct?”, we pick up with the Gary Dunlap case and the massive documented prosecutorial misconduct by the same prosecutors now in charge of the Michael Jackson “case”.

To refresh, Dunlap is an attorney who was accused of crimes allegedly because prosecutors wanted to get him “out of the way”. He was winning too many excessive force cases against the police department. Dunlap was acquitted on all charges and is now suing Sneddon, including Deputy DAs and investigators, for $10M in federal court.

We have already learned of prior bad acts with prosecutors, including the current DA Sneddon. And, no, ‘DA’ does not stand for “dumb ass”, although some who have had run-ins with him may argue such. There is a pattern of misconduct with the way prosecutors use the media to further their cause, with the way these prosecutors handle the grand jury process and with the way they investigate a case, if we look at the evidence from Dunlap’s case.

Exclusive: Docs from Druyan Byrne Case Reveal Pattern of Misconduct? – #193

Documents obtained by MJEOL concerning the Druyan Byrne case reveal a pattern of questionable tactics, witness intimidation, vindictive prosecution, jury pool tainting through the media and other misconduct by the Santa Barbara Sheriff’s Dept and prosecutors. The same prosecutors and police who are currently trying to railroad Michael Jackson.

Druyan, too, was investigated and charged with lewd acts upon a minor. The Santa Barbara police detective, Stuart Gardner, according to the documents, browbeat the 15 year old girl without a parent present until she gave in and “confessed”.

She later testified at the preliminary hearing that nothing happened between she and Byrne. She also submitted a declaration where she denied any such abuse.

Not to be content with that, prosecutors and police found a 20 year old drug addict and prostitute to make claims against Byrne earlier this year.

It has also been revealed that Victor Guiterrez was a “consulting producer” for the defamatory Dateline report, as you can see from a screenshot here of Dateline’s credits.

For the record, Gutierrez is the loser who was successfully sued by Jackson for claiming there was a videotape of Jackson molesting a kid. This, of course, was a malicious lie. There is some question as to who this “kid” was supposed to be. At one point, it was reported to be the maid’s son, Blanca Francia.

More Lies from Dateline as 1993 Shysters Resurface – MJEOL Bullet #192 What Dateline NBC Didn’t Tell You Since Dateline NBC has taken it upon itself to further taint the jury pool by dredging up mythical alleged “victims” from the 1990s, maybe we all need to think about why this is airing now, and what they aren’t telling the public.

The desperation tactic predicted months ago was that once the prosecution and prosecution-sympathizers started heavily pushing unfounded lies from the 93 “case” onto the public, that’s a sign that this current “case” is in very serious trouble. Well, here comes the ‘93 barrage.

Thus, the question is what has imploded with this current “case”? Could this be a pre-emptive strike to take attention off of the current accuser’s mother set to testify September 17 2004? Is this the DA’s PR firm hard at work to combat an impending crisis with the DA’s office or the Sheriff’s Department?

Josh Mankowitz has taken his career into the palm of his hands and put Dateline NBC—not known for their factual Jackson reports—on the line as well. They have given a platform to a group of peripheral players who thrive in chaos and who are masters at spreading unfounded and groundless garbage.

A number of the ghosts from 1993 have made claims of having a “strong case” back then. Not true. They claim there was “evidence” in 1993. Not true. They claim there was more than one accuser in 1993. Not true.

Sneddon has History of Prosecutorial Misconduct? 3-Part MJEOL Bullet #190 In the face of prosecutors now trying desperately to convict Michael Jackson in the court of public opinion, there seems to be a developing story surrounding the current Santa Barbara district attorney’s propensity to level criminal charges and allegations against attorneys who, some say, are in the way of a case he’s attempting to prosecute.

The DA’s office apparently has a history of ruining the reputations, practices, and lives of attorneys and others, who they deem as preventing them from pursuing a case. Just last week, prosecution sympathizer and tabloid reporter Diane Dimond made claims on Court TV’s Crier Live that her sources say prosecutors are inclined towards bringing attorney Mark Geragos into this conspiracy charge against Jackson.

This is a “case” where prosecutors seem to be leveling criminal allegations at any and everyone who was around Jackson to witness the “manipulative” and threatening behavior of the accuser’s mother.

As dubious as Dimond’s sources have proven to be, what if there is some semblance of truth to what she and her sources are claiming? It certainly wouldn’t be the first time the current district attorney, “cronies” in tow, have attempted to prosecute and/or ruin the reputations of a lawyer he sees as standing in the way of them getting what they want.

Melville Defies Appeals Court, Denies Bail Reduction Again – MJEOL Bullet #189 Update#2 First, the judge in the Michael Jackson “case” allows prosecutors to violate the gag order without any repercussions. Now he’s thumbed his nose at the Appeals Court by continuing to deny the reduction of Jackson’s unconstitutional $3M bail.

In his August 31 ruling, Judge Rodney Melville uses further speculation about everything from the 1993 “case”, to Jackson’s alleged “similar ties” to places all over the world.

Some observers say this is completely ridiculous and should require a higher court to step in again to finally resolve this issue. The Court of Appeals has already remanded the bail reduction ruling back to Melville’s court and requested him to show why he still hasn’t reduced Jackson’s bail in accordance with the law.

Where is Melville getting his reasoning? If I hadn’t been paying attention, I would have thought I was reading a motion from the prosecution.

Part3: Fireworks as Kent takes on Crier, Dimond a No-show –MJEOL Bullet #188 Mysteriously, Crier Live wasn’t shown today (Aug 30). But there were fireworks in part 3 of tabloid reporter Diane Dimond’s report, which aired August 27, trying to destroy Marc Schaffel and link his past with Michael Jackson. Again, there was more questionable information from Us Weekly’s Ian Drew, whose involvement was discussed in MJEOL Bullet #187. Drew claims Schaffel was a kingpin of sorts in Jackson’s organization. Sources say nothing could be farther from the truth.

As a way to convict Jackson of some imagined behavior, Schaffel was used to create a story where there is none. Catherine Crier also seemed to run so fast from it that you’d think Dimond’s report was the plague.

In this part, we got more from scorned wanna-be-insider Ian Drew. In the report, Dimond claims Drew has interviewed Jackson numerous times. Drew, who used to work for the tabloid The Globe, took it upon himself to level a number of unconfirmed, unfounded and questionable claims against Jackson’s associates. He also brings Jackson attorney Mark Geragos into the fray; at one point, claiming that Geragos was in contact with Schaffel during the time when an alleged “conspiracy” was on-going.

Part 2: Dimond Goes Into Destroy-Mode w/Alleged Co-conspirators – MJEOL Bullet #187 Continuing the tirade against Marc Schaffel, tabloid reporter Diane Dimond aired part two of a three part series into desperately and ridiculously trying to link Schaffel’s sordid past with Michael Jackson. The ‘guilty by association’ garbage seems to have been designed specifically to use the people around Jackson to destroy his credibility. Needless to say, it failed miserably. On a side note, we also get a glimpse into why Us Weekly magazine can’t seem to write a fair and accurate Jackson report to save its figurative life.

Dimond furthered her whatever-sticks story yesterday (Aug 26) on Schaffel, possibly because he’s seen as the easiest target and most subject to blackmail of all the 5 prosecution-alleged “co-conspirators”. She also revealed, according to her “sources” (so take it with a grain of salt), that law enforcement may actually be using a disgusting theory which has Schaffel “finding young men” for Jackson.

Without so much as an ounce of evidence, proof, or information relating to that theory, it is apparently what they’re trying to claim. No I’m not kidding. As ill-conceived and unhinged as it sounds, that’s allegedly what her sources are using her to pump out into the public. Some observers have said that it’s quite clear they want to make their case, instead of searching for the truth.
