Stupidity Rules in Santa Barbara – MJEOL Bullet #42

District Attorney Tom Sneddon has released a statement today (Dec 15) saying he will file charges against Michael Jackson either Thursday (Dec 18) or Friday (Dec 19) of this week. Fox news reporter Geraldo Rivera announced on a recent show that he has spoken to a member “at the heart of the defense team.”

Rivera reports that if the D.A. pushes ahead with filing charges, the defense will not hesitate in making sure all of the huge, gaping holes in the prosecution’s case are made known to the public.

One of those gaping holes was revealed by thesmokinggun.com (see Internal Memo: Case Against Jackson ‘Unfounded’). That highly damaging summary memo is, it turns out, backed by a huge case file compiled by Child Protective Services (CPS), reports thesmokinggun.com.

[b]DA Tactic: Discredit DCFS Investigation? – MJEOL Bullet #40[/b] District Attorney Tom Sneddon’s case was largely panned by news agencies around the world after an incredibly damaging memo surfaced concluding that the allegations against Jackson are “unfounded.” However, a new tactic has surfaced the day after: discredit the investigation done by the Department of Children & Family Services (DCFS). Despite reports that trained DCFS professionals talked to the family—more than once, separately from each other, and on more than one occasion—reporters and news agencies sympathetic to the prosecution (Court TV, Celebrity Justice, Catherine Crier, Jerry Nachman, Paula Zahn etc.) have made reports attempting to cast doubts on the validity of the DCFS/LAPD investigation… By accounts from those close to the family, Jackson would not be in-charge of anyone else’s child/children and not have another person or persons there 24 hours a day in case of emergencies; even when they are asleep in his room. To understand that point, you must understand the logistics of these occasional Neverland “sleepovers.” Note these two quotes from Jackson family attorney Brian Oxman, via a transcript of his appearance on Fox news the show hosted by Bill O’Reilly in March of this year:

Case against Jackson Going Up in Smoke? Bullet #39

MSNBC host Joe Scarborough (Scarborough Country) spoke with members close to the Jackson family, as well as a noted defense attorney and Court TV’s Lisa Bloom on his Dec 9 show. In Scarborough’s opening remarks, he says:

…the case against Michael Jackson is going up in smoke…The DA’s charges against Michael Jackson are collapsing like a house of cards. Today, a bombshell blew a hole in the DA’s case…”

That bombshell is the leaked memo which stated that a neutral 3rd party, the Department of Children & Family Services (DCFS) independently investigated allegations of molestation against Jackson earlier this year. They found those accusations to be “unfounded,” thus, without merit. An investigation was done in Feb 2003 in which all members of the family—mother, accuser, accuser’s bother and sister—flatly denied any wrongdoing whatsoever. There were multiple interviews conducted by the DCFS in which each member of the family was spoken to separately… One of the major holes in the prosecution’s case is trying to convince a jury beyond a reasonable doubt that Jackson would specifically molest the exact same child—after an investigation, after the mother already sought a civil attorney for who knows what reason, and after a public outcry against misunderstood relationships he’s had with children in general—who initially spurred an investigation into his relationship with children. :4pinnedREAD FULL REPORT >>

Investigators: Allegations Against Jackson Unfounded Bullet #37

[b]Internal Memo: Allegations Against Jackson Unfounded MJEOL Bullet #3[/b] In a bombshell report out today (Dec 9), thesmokinggun.com has found an internal memo which concludes that the “allegations of neglect and sexual abuse” leveled against Jackson are in fact “unfounded.” Both the LAPD-Wilshire Division and the Department of Children & Family Services did the investigation. It further states that the mother confirmed that Jackson “was like a father to the children and a part of her family.” As to the actual allegations and the media skewing Jackson’s words, the mother also confirmed “that her children are never left alone with the entertainer.” The fact that Jackson is seldom, if ever, alone with any child is also confirmed by Jackson family attorney, Brian Oxman. Oxman appeared on Fox news show hosted by Bill O’Reilly earlier this year and addressed this subject.He stated:

Another issue coming as a result of this information is the timeline when abuse was supposed to have taken place. When reports first broke of this latest allegation, it was also reported that the accuser was 12 when the alleged abuse was suppose to have taken place. The accuser recently turned 14 this year. Thus, if this is the case, the alleged abuse had to have taken place [b]before[/b] the mother, the accuser, the brother and the sister of the accuser signed legal documents stating that no sexual abuse happened at all. Make no mistake about it: this is very damaging to the prosecution’s case. At the very least—regardless of the excuses commentators sympathetic to the prosecution try to make to explain away the conclusion of the investigation—it shows a propensity for this accuser to tell lies, possibly at the mother’s request. :4pinnedRead the FULL report >>

[b]Prosecution and Accuser’s Family Leaking Information? – MJEOL Bullet #36[/b] The New York Times published a rather scathing article questioning whether or not the prosecution in the Jackson case actually [i]has[/i] a case against the singer. In the Times article, it’s reported that the tip line set up by the sheriff’s department has yielded little to no viable leads and no new allegations against Jackson. Sgt Chris Pappas is quoted in the article as saying “At this point in time, none [calls] have clearly identified new cases for independent investigation.” A second issue surfacing now is reports saying this latest accuser’s brother actually witnessed the alleged molestation on one occasion. This new information is also being probed by some in the media who have already been snake-bitten by false information from faulty “sources”. In a discussion on MSNBC’s Scarborough Country (Dec 5 2003), it is reported that Lisa Bloom actually let it slip that the accusing family contacted Court TV proclaiming that the brother of the accuser was going to testify that he witnessed the alleged abuse by Jackson once. It is incredibly suspicious why this family would be contacting any media outlets to begin with. There is also a question as to if the D.A’s office urged them to contact Court TV or if they acted on their own volition. These actions could have been set into motion in order to turn the media tide back in the prosecution’s favor. Dimond Uses Jackson for Financial Gain……Again – MJEOL Bullet #33

Court TV’s Diane Dimond has once again used Michael Jackson to procure gains in her financial and career status. It was announced on the Business Wire (Nov 24) that she will now host Court TV’s Hollywood at Large.

Dimond’s obvious reward for reporting various Jackson information, confirmed or not, has been examined by some who see her as little more than a gossip-monger with an unjustly elevated platform. The press release announcing her supposed triumph specifically points to her work with breaking the recent Jackson story as a way to convince people of her alleged worthiness for the new position.

However, upon closer inspection, one could wonder what the COO of Court TV, Art Bell, is thinking by making her their new star. Dimond rode to fame working for the now defunct tabloid TV show Hard Copy. She got into hot water with Jackson, and the law, when she was spreading a damaging lie about the 1993 case from one of her “sources.”
